Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the https://mindbodyoasis.co.uk website (the “Service”) operated by MindBody Oasis (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Your Agreement

It is important to note that in booking an appointment either via our web booking service or by phone or email (contact@mindbodyoasis.co.uk) you are agreeing to our Terms & Conditions and our Privacy Policy. You also agree to attend the appointment you have booked.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of MindBody Oasis and its licensors.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by MindBody Oasis.

MindBody Oasis has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that MindBody Oasis shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Appointment Cancellation Policy

At MindBody Oasis we operate a cancellation policy of 24 hours’ notice. Failure to attend an appointment with less than 24 hours’ notice of cancellation will incur the full charge of the appointment. This is because we may not be able to fill your appointment slot and still need to cover our costs.

Please cancel as soon as possible if a foreseeable event is likely to prevent you from attending, for example, illness or adverse weather conditions. If you need to cancel your appointment at short notice because of a long-term medical condition which varies from day to day, or in the event of a family death or because you are more than 37 weeks pregnant, then we shall discuss the cost implications on a case by case basis.

An invoice for any cancellation / ‘no show’ charges will be sent to you by email for payment by bank transfer within 7 days. Following a cancellation, payment must be received before any further bookings can be taken.

Late Arrivals

It is important that our agreed appointment time and duration is adhered to. We appreciate that sometimes things happen, and you may arrive a little later or need to leave a bit earlier than planned. This is fine, but we cannot make up the missed time by overrunning or adding time to subsequent appointments.

Termination of Our Service

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

Confidentiality

We ensure that all client information and clinical records will be kept in a safe place and will remain confidential. Unless required to do so by law or for urgent medical reasons, we will not share, sell or distribute any of the information you provide to us without your prior consent. Our consultation form allows us to refer you to members of the healthcare or complementary therapy service if we deem this appropriate to your physical or mental wellbeing.

Consultations and client treatment details will not be discussed with anyone other than the client, unless the client is under the age of 18 or has a care worker or guardian.
To prevent unauthorised access or disclosure, we employ security measures to protect your information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage. We have also put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. We will retain your information for a reasonable period or as long as the law requires.

Each therapist working for MindBody Oasis will have access to these records, but only for the duration of their contract with MindBody Oasis, and solely for the purpose of providing you with the most appropriate treatment.

Health & Safety

All therapists at MindBody Oasis are qualified, and hold professional and public indemnity insurance, for the services that they provide.

Due to the nature of the services we provide and the need for close contact, all MindBody Oasis therapists will maintain a high standard of personal hygiene. In turn, we expect the same of our clients. If a therapist is unwell, suffering from a cold or virus, infection or general ill health, they will not be allowed to work due to the risks of cross-contamination. This may result in MindBody Oasis contacting you to inform you of the issue at the earliest opportunity to make suitable alternative arrangements.

Clients are asked not to attend for a treatment if they are unwell, suffering from a cold or virus, infection or general ill health. Please contact MindBody Oasis email at contact@mindbodyoasis.co.uk at the earliest opportunity to re-arrange your appointment. If you are unwell and contact us to inform us of your illness, please note that our Cancellation Policy may still apply.

Clients under the age of 18 years must be accompanied by a parent or guardian. This parent or guardian must give permission for the agreed treatment or treatment plan to be performed and will be requested to co-sign the New Client Consultation Form. They will be invited to stay in the room for the duration of the appointment and expected to remain present throughout the treatment.

MindBody Oasis holds the right to refuse any treatment if a client is physically or verbally abusive towards any therapist, or demonstrates inappropriate, aggressive or sexual behaviour. Such behaviour may result in a partial or total ban from MindBody Oasis and may also result in criminal proceedings.

Neither MindBody Oasis, including any of their therapists, nor the Holiday Inn Cardiff North hotel management will be held responsible for the loss or damage of your personal items during your time at MindBody Oasis.

Disclaimer

MindBody Oasis provide massage therapy, reflexology, reiki and bodywork in a variety of forms, but none of these bodywork modalities are a substitute for professional medical care or counselling. None of the therapists at MindBody Oasis will diagnose, prescribe medication or medical treatment of any kind, unless they are personally qualified to do so, and will always recommend referral to a GP or other qualified medical specialist or practitioner.

The client has a duty to provide accurate and true medical and personal information, to the best of their knowledge, and to keep MindBody Oasis up to date with details of any medication, symptoms, medical concerns or treatments they are having investigated or undergoing treatment for.

All therapists at MindBody Oasis may refuse to treat any client or part of their body with just and reasonable cause. MindBody Oasis reserves the right to terminate any appointment at any time if they believe that it is not safe or is not in the client’s best interest to proceed. Likewise, the client has the right to refuse, modify or terminate treatment at any time, regardless of prior consent given.

Your use of our Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of United Kingdom without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
