<p>You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.</p>
<p>You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.</p>

<p>We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.</p>
<h2>Appointment Cancellation Policy</h2>
<p>At MindBody Oasis we operate a cancellation policy of 24 hours’ notice. Failure to attend an appointment with less than 24 hours’ notice of cancellation will incur the full charge of the appointment. This is because we may not be able to fill your appointment slot and still need to cover our costs.</p>
<p>Please cancel as soon as possible if a foreseeable event is likely to prevent you from attending, for example, illness or adverse weather conditions. If you need to cancel your appointment at short notice because of a long-term medical condition which varies from day to day, or in the event of a family death or because you are more than 37 weeks pregnant, then we shall discuss the cost implications on a case by case basis.</p>
<p>An invoice for any cancellation / ‘no show’ charges will be sent to you by email for payment by bank transfer within 7 days. Following a cancellation, payment must be received before any further bookings can be taken.</p>
<h2>Late Arrivals</h2>
<p>It is important that our agreed appointment time and duration is adhered to. We appreciate that sometimes things happen, and you may arrive a little later or need to leave a bit earlier than planned. This is fine, but we cannot make up the missed time by overrunning or adding time to subsequent appointments.</p>
<h2>Termination of Our Service</h2>
<p>We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.</p>
<p>All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.</p>
<p>We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.</p>
<p>Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.</p>

<h2>Confidentiality</h2>
<p>We ensure that all client information and clinical records will be kept in a safe place and will remain confidential. Unless required to do so by law or for urgent medical reasons, we will not share, sell or distribute any of the information you provide to us without your prior consent. Our consultation form allows us to refer you to members of the healthcare or complementary therapy service if we deem this appropriate to your physical or mental wellbeing.</p>
<p>Consultations and client treatment details will not be discussed with anyone other than the client, unless the client is under the age of 18 or has a care worker or guardian.<br />
To prevent unauthorised access or disclosure, we employ security measures to protect your information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage. We have also put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. We will retain your information for a reasonable period or as long as the law requires.</p>
<p>Each therapist working for MindBody Oasis will have access to these records, but only for the duration of their contract with MindBody Oasis, and solely for the purpose of providing you with the most appropriate treatment.</p>

<h2>Health &amp; Safety</h2>
<p>All therapists at MindBody Oasis are qualified, and hold professional and public indemnity insurance, for the services that they provide.</p>
<p>Due to the nature of the services we provide and the need for close contact, all MindBody Oasis therapists will maintain a high standard of personal hygiene. In turn, we expect the same of our clients. If a therapist is unwell, suffering from a cold or virus, infection or general ill health, they will not be allowed to work due to the risks of cross-contamination. This may result in MindBody Oasis contacting you to inform you of the issue at the earliest opportunity to make suitable alternative arrangements.</p>
<p>Clients are asked not to attend for a treatment if they are unwell, suffering from a cold or virus, infection or general ill health. Please contact MindBody Oasis email at <a href="mailto:contact@mindbodyoasis.co.uk">contact@mindbodyoasis.co.uk</a> at the earliest opportunity to re-arrange your appointment. If you are unwell and contact us to inform us of your illness, please note that our Cancellation Policy may still apply.</p>
<p>Clients under the age of 18 years must be accompanied by a parent or guardian. This parent or guardian must give permission for the agreed treatment or treatment plan to be performed and will be requested to co-sign the New Client Consultation Form. They will be invited to stay in the room for the duration of the appointment and expected to remain present throughout the treatment.</p>
<p>MindBody Oasis holds the right to refuse any treatment if a client is physically or verbally abusive towards any therapist, or demonstrates inappropriate, aggressive or sexual behaviour. Such behaviour may result in a partial or total ban from MindBody Oasis and may also result in criminal proceedings.</p>
<p>Neither MindBody Oasis, including any of their therapists, nor the Holiday Inn Cardiff North hotel management will be held responsible for the loss or damage of your personal items during your time at MindBody Oasis.</p>
<h2>Disclaimer</h2>
<p>MindBody Oasis provide massage therapy, reflexology, reiki and bodywork in a variety of forms, but none of these bodywork modalities are a substitute for professional medical care or counselling. None of the therapists at MindBody Oasis will diagnose, prescribe medication or medical treatment of any kind, unless they are personally qualified to do so, and will always recommend referral to a GP or other qualified medical specialist or practitioner.</p>
<p>The client has a duty to provide accurate and true medical and personal information, to the best of their knowledge, and to keep MindBody Oasis up to date with details of any medication, symptoms, medical concerns or treatments they are having investigated or undergoing treatment for.</p>
<p>All therapists at MindBody Oasis may refuse to treat any client or part of their body with just and reasonable cause. MindBody Oasis reserves the right to terminate any appointment at any time if they believe that it is not safe or is not in the client’s best interest to proceed. Likewise, the client has the right to refuse, modify or terminate treatment at any time, regardless of prior consent given.</p>
<p>Your use of our Service is at your sole risk. The Service is provided on an &#8220;AS IS&#8221; and &#8220;AS AVAILABLE&#8221; basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.</p>
<h2>Governing Law</h2>
<p>These Terms shall be governed and construed in accordance with the laws of United Kingdom without regard to its conflict of law provisions.</p>

<p>When you buy a gift voucher we collect personal details, such as your name, email, recipient’s name and possibly a postal address. This information is used to identify you and provide the service you have requested.</p>

<p>For the purpose of legal protection, we are required to hold the personal information you have given to us in the course of providing our services and products for a minimum of seven years. Seven years after your last treatment or product purchase we will permanently delete all your personal information that we hold.</p>
<p>If you withdraw your consent during the seven-year retention period, we will archive your data until the seven-year period expires.  Whilst your information is archived, we will not access or process it in any way except if required by law or for legal protection purposes.</p>

<p>Our new booking system is provided by a third party called Fresha.com (previously known as Shedul.com). The data that this site captures will include your full name, email, telephone/mobile number. marketing and booking preferences as well as billing address and payment details. Your data and the protection thereof will be subject to their Privacy Policy, so please take care to read this before booking via this system.</p>
<p>Our site (predominantly the blog area) may also contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party&#8217;s site. <h2>Data Sharing and Disclosure</h2>
<p>Unless required to do so by law or subpeona, we shall not otherwise share, lease, sell or distribute any of the information you provide to us without your prior consent. Our consultation form indicates a consent for GP, healthcare practitioner or other complementary therapist referrals should we deem this an appropriate course of action.</p>
<h2>Data Security</h2>
<p>Our appointment booking service is provided by Fresha. Your data is stored through using their data storage facilities, databases and Web framework, on secure servers that are always encrypted when in storage and whilst being transmitted across the internet.</p>
<p>Our electronic correspondence and mailing service is provided by both Google and Mailchimp or Mailerlite, who similarly store and transmit client data using secure servers.<br />
Our electronically completed consultation forms and client correspondence are held in a password-encrypted location on our computer.  All client paper records are held in a lockable, fire-proof safe which is kept in an access-restricted location away from the eyes of the general public.</p>
<p>The Fresha system will enable you to pay for bookings online. We also allow you to make payment by cash, iZettle or Sumup (if paying in person on the day of the treatment) or BACS either in advance of the treatment or immediately after completion of the treatment.  We will notify you of any change to this payment arrangement via e-mail.</p>
<p>All credit card detail storage is encrypted through the Payment Card Industry Security Standard (PCI-DSS).  Our third party payment system providers adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.</p>
<p>Once you leave our website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms &amp; Conditions.  You are to be mindful of their respective policies and terms and conditions.</p>
<p>We make every possible effort to follow industry best practice in protecting and storing your data, such that it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.</p>
